TERMS & CONDITIONS:
All rentals are subject to the following terms and conditions: BOOKING:
The signing of the booking form confirms the acceptance of
the terms and conditions set out below and shall be binding
on the persons intending to occupy the premises whether
or not such persons have signed the booking form. Each
booking will be confirmed as soon as reasonably possible
after receipt of the signed booking form and the appropriate
deposit. RESERVATION DEPOSIT AND PAYMENT OF BALANCE:
The reservation deposit of £200/$350 is payable
with the completed booking form. The full balance is
payable no
later than 8 weeks prior to the date of rental (unless the villa owner's individual home terms demand otherwise.) AVAILABILITY:
To enable cleaning and preparation to be completed between
rentals, the premises will be available for occupation
from 4 p.m. on the first day of the rental period and vacated
by 10 a.m. on the day of departure, unless otherwise requested (fee may apply for late check out)
LIABILITY:
Your property is privately owned, “ TKF Consultants”,
the homeowners, and the management personnel, accept no responsibility
whatsoever for personal injury, accidents, loss or damage
to persons or personal effects however caused. SAFETY & SECURITY:
Under no circumstances may more than the maximum number of
persons identified on the booking form occupy the property,
except by prior written agreement. Our management personnel
reserve the right to refuse admittance if this condition
is not observed. ADDITIONAL SECURITY DEPOSIT:
In addition to the reservation deposit, a security
deposit of £200/$350 is payable to cover
breakages or damage to the premises and/or its
contents, missing items, or
cleaning costs (i.e., stains or spills to carpets or furniture).
THE CLIENT AGREES TO:-
PAY THE FULL COST OF ANY BREAKAGES, LOSSES OR DAMAGE TO THE
PROPERTY.
TO REPORT ANY DAMAGE OR LOSS IMMEDIATELY IT IS DISCOVERED
TO THE LETTER’S MANAGEMENT COMPANY.
TO TAKE GOOD CARE OF THE PROPERTY AND LEAVE IT IN CLEAN AND
TIDY CONDITION AT THE END OF THE HOLIDAY. It
should be noted that the property will be clean, and
beds made ready for your arrival and that the clean charge
on departure is included in the rental fee. However, laundering
of dirty linen in excess of one set per bed will be charged
for and deducted from the security deposit. For non-return
of keys, a charge of £200/$350 will be payable. (Locks
will be changed for security purposes.) Keys should be kept
in the lock boxes provided. The security deposit is refundable, within 30 days of vacating
the premises, on verification from the management personnel,
that all is in order and that no damage has occurred. TKF Consultants will have the right to make the final decision in
cases of disagreement between management, guest and villa
owner. CANCELLATIONS:
WE STRONGLY RECOMMEND THAT GUESTS TAKE OUT APPROPRIATE HOLIDAY
INSURANCE TO COVER CANCELLATION FEES AND OTHER LOSSES WHICH
MAY OCCUR.
If the balance of the sum due (as shown on the booking form),
remains unpaid 8 weeks prior to the rental arrival date,
the Owners reserve the right to cancel the booking, and in
this event, the deposit will be forfeited. If the client
cancels after the booking is confirmed the following cancellation
charges apply:
More than 8 weeks Loss of deposit
Less than 8 weeks 100% of rental fee UNAVOIDABLE CHANGES:
If after the booking you need to change your vacation dates,
we will do our best to make the requested change in the
same home. However, if this is not possible the above cancellation
charges apply. The property owner reserves the right to
amend or cancel the booking where necessitated by circumstances
beyond his control. In such circumstances,TKF Consultants Ltd
will notify the client immediately that it becomes aware
that an amendment or cancellation is necessary, and will
take all reasonable steps to replace the cancelled booking
with a property of similar or better standard in as similar
location as possible to the rented property. In the event
that TKF Consultants is unable to suitably replace the
cancelled booking, all monies paid by the client to the
property owner will be refunded and the property owner/TKF Consultants will not be under any further liability
to the client. FORCE MAJEURE:
TKF Consultants or The Villa Owner accept no responsibility
or liability whatsoever for any loss or damage or alteration
to the terms of the booking affected by matters over which
they have no control, including, but not limited to, war,
hostilities, strikes or other industrial disputes, natural
disasters, fire, acts of God, terrorist activities, technical
problems with transportation, flight delays or cancellation,
epidemics, weather conditions, government action or other
circumstances amounting to "force majeure". COMPLAINTS:
Should a problem arise relating to the premises the client
should contact the local management personnel. TKF Consultants will have the right to make the final decision
in cases of disagreement between villa owner, management
and guest.
General:
1. Lessee may not let, sublet or assign this short-term rental. 2. Lessee shall not make any alterations to the property
or change any fixtures, fittings or contents. 3. Lessee and/or any guests and visitors shall not disturb,
annoy, endanger, inconvenience, nor conduct themselves in
a manner deemed offensive to neighbors. 4. The premises shall not be used for any immoral or unlawful
purposes. 5. No unlawful drugs are permitted on the premises. 6. No firearms are permitted on the premises. 7. No pets at all can be taken into or be kept on the property
by our clients or their visitors. 8. Guests must observe all pool rules. 9. Swimming is only permitted where 2 or more persons are
present. No child under the age of 16 is permitted in the
pool unless under the supervision of an adult (aged 18 or
over). 10. No diving in to the pool is permitted. 11. The lessee accepts full responsibility for the safety
of tenants and guests in both the pool and house areas. 12. For the comfort of future guests, NO SMOKING is permitted
in the villa. Tenants are requested to smoke only in outdoor
areas. Deductions form the security deposit will be made
for cleaning of furnishings in the villa if this condition
of let is breeched 13. The lessee agrees to indemnify and save the lessors
harmless from all liability, loss or damage arising from
any nuisance or harm made or suffered on the leased premises
by the lessee, tenants, or guests, or from any careless,
neglect, or improper conduct of any persons entering, occupying
or visiting the leased premises. 14. The lessee shall make available, following a notice
period of not less than 24 hours, access to the property
to the lessors, their managing agents or sub-contractors
for the purposes of carrying out any necessary repairs, refurbishment
or change of furnishings. 15. The lessee shall take responsibility for any care, duty
or health and safety requirements as dictated by law. Exceptions
only being where responsibility lies with the lessors or
managing agents for the property. 16. If the lessee abandons or vacates the premises, the
lessors may, at their discretion, terminate the agreement,
enter the premise and/or remove all property belonging to
the lessee and guests. 17. The lessee assumes full responsibility for fulfilling
and ensuring all the terms and conditions of this agreement
are strictly adhered to and shall maintain the premises in
good order and appearance. Further, the lessee accepts responsibility
for any outstanding or unpaid charges that arise from the
entering of this agreement or during their term of occupancy. 18. The lessors or their representatives cannot prevent
the possible breakdown of equipment or appliances during
the tenancy period, and although these will be fixed as soon
as practically possible, no responsibility is taken for any
inconvenience caused as a result. 19. Where pool heating has been requested, the lessors do
not guarantee the temperature of the pool, which can vary
in accordance with weather conditions. 20. During the tenancy period, the lessors or their representatives
accept no responsibility whatsoever for death, personal injury,
accident, loss or damage to persons or personal effects however
and wherever caused on the premises (indoor or outdoor). 21. As your holiday villa is located on a development that
consists of both residential and vacation homes, neither
the lessors nor their managing agents or representatives
accept responsibility for any ongoing construction, alteration
to houses, or any noise or nuisance of any kind above and
beyond the control of the lessor. 22.
The barbecue available for guests’ use, if used,
is done so at the guests’ own risk. It is the responsibility
of the lessee to ensure the barbecue is cleaned prior to
departure so that it may be used by future guests (i.e. left
as you would expect it to be found!). A deduction from the
security deposit is made if this condition of let is breeched. 23. The lessee undertakes that, if the barbecue is used,
it is not done so within the confines of the screened area.
The lessee hereby indemnifies the lessors for any damage
caused as a result of non-compliance. (WARNING: THE HEAT
FROM THE BARBECUE MAY CAUSE DAMAGE TO THE SCREEN. USA lets
only) 24.
The cot and high chair on the premises is there for the
lessors’ use. Although guests are free to use this
equipment, they do so at their own risk. Should
any terms or conditions detailed in this agreement be
violated (by the lessee, guests or their invited guests)
TKF Consultants or the villa owners (herein and after referred
to as the ‘lessors’) may terminate the tenancy
at any time without any recourse whatsoever from the lessee.
